REVISOR'S NOTE: This section is new language patterned
after the second clause of the first sentence of
Article 43, § 2, as that clause relates to
disease. Article 43, § 2 is retained there since
parts of that section are revised in the Health -
Environmental Article.

The defined term "Secretary" is substituted for
the obsolete reference to the former State Board
of Health and Mental Hygiene".

18-102. INFECTIOUS AND CONTAGIOUS DISEASES.

(A)  RULES AND REGULATIONS.

THE SECRETARY SHALL ADOPT RULES AND REGULATIONS
NECESSARY TO PREVENT:

(1)  THE INTRODUCTION OF AN INFECTIOUS OR
CONTAGIOUS DISEASE INTO THIS STATE; OR

(2)  THE SPREAD OF AN INFECTIOUS OR CONTAGIOUS
DISEASE IN THIS STATE.

(B)  RIGHT OF ENTRY; INSPECTIONS.

THE SECRETARY MAY ENTER ON AND INSPECT PRIVATE PROPERTY
TO DETERMINE THE PRESENCE, CAUSE, AND SOURCE OF AN
INFECTIOUS OR CONTAGIOUS DISEASE.

REVISOR'S NOTE: Subsection (a) of this section is new
language derived without substantive change from
the first clause of the first sentence of former
Article 43, § 31, as that clause related to
diseases. It is revised to require the Secretary
to adopt rules and regulations, rather than to
require the Commissioner of Health to recommend
rules and regulations for adoption, since the
position of State Commissioner of Health has been
abolished. See the General Revisor's Note to
this article.

Subsection (b) of this section is new language
patterned after the first clause of the second
sentence of Article 43, § 2, as that clause
relates to diseases.
