17-413. UNAUTHORIZED TESTS.

A PERMIT HOLDER MAY NOT OFFER OR PERFORM ANY TEST THAT
IS NOT AUTHORIZED BY THE PERMIT.

REVISOR'S NOTE: This section is new language derived
without substantive change from the third
sentence of former Article 43, § 54K(c)(l).

Defined term: "Permit" § 17-401

17-414. PENALTIES.

A PERSON WHO VIOLATES ANY PROVISION OF THIS SUBTITLE IS
GUILTY OF A MISDEMEANOR AND ON CONVICTION IS SUBJECT TO A
FINE NOT EXCEEDING $100 FOR THE FIRST OFFENSE AND NOT
EXCEEDING $500 FOR EACH SUBSEQUENT CONVICTION FOR A
VIOLATION OF THE SAME PROVISION. EACH DAY A VIOLATION IS
CONTINUED AFTER THE FIRST CONVICTION IS A SUBSEQUENT
OFFENSE.

REVISOR'S NOTE: This section formerly appeared as
Article 43, § 54K(f).

The reference to a "subsequent conviction for a
violation of the same provision" is substituted
for the reference to a "successive offense", for
clarity.

The only other changes are in style.

GENERAL REVISOR'S NOTE:

The Commission to Revise the Annotated Code notes, for
consideration by the General Assembly, that, while the
Secretary and Medical and Chirurgical Faculty of the State
of Maryland developed standards and qualifications for
medical test units, the standards and qualifications were
not adopted as rules and regulations. Therefore, no permits
are being issued under this subtitle, and it is not being
enforced otherwise.
