medical test units were developed, they were not
adopted. Therefore, permits are not being issued
under this subtitle, and it is not being
enforced.

In subsection (b)(2) of this section, the
reference to offering the examinations "in this
State" is added to clarify those units regulated
under this subtitle. See § 17-404 of this
subtitle.

Former Article 43, § 53K(a)(3), which defined
"Secretary", is deleted as unnecessary in light
of the definition of that term in § 1-101 of this
article.

17-402. STANDARDS, QUALIFICATIONS, AND INSPECTIONS OF
MEDICAL TEST UNITS.

(A)  STANDARDS AND QUALIFICATIONS.

(1)  IN COOPERATION WITH THE MEDICAL AND
CHIRURGICAL FACULTY OF THE STATE OF MARYLAND, THE SECRETARY
SHALL ADOPT RULES AND REGULATIONS THAT SET STANDARDS AND
QUALIFICATIONS FOR MEDICAL TEST UNITS.

(2)  THE RULES AND REGULATIONS SHALL CONTAIN
STANDARDS AND QUALIFICATIONS THAT ASSURE THE CITIZENS OF
THIS STATE THAT:

(I)  MEDICAL TEST UNITS OFFER SAFE AND
RELIABLE TESTS; AND

(II)  QUALIFIED STAFF PROPERLY PERFORM AND
SUPERVISE EACH TEST.

(B)  INSPECTIONS.

TO ASSURE COMPLIANCE WITH THE STANDARDS AND
QUALIFICATIONS ADOPTED UNDER THIS SUBTITLE, THE SECRETARY
SHALL HAVE AN INSPECTION MADE:

(1)  OF EACH MEDICAL TEST UNIT FOR WHICH A PERMIT
IS SOUGHT; AND

(2)  PERIODICALLY OF EACH MEDICAL TEST UNIT FOR
WHICH A PERMIT HAS BEEN ISSUED.
