in this subtitle, although the Department now regulates only
one class of tissue bank -- i.e., the blood bank. The
Department has indicated that it does not believe that
regulation of other types of tissue banks is necessary or
practicable at this time.

SUBTITLE 4. MEDICAL TEST UNITS.

17-401. DEFINITIONS.

(A)  IN GENERAL.

IN THIS SUBTITLE THE FOLLOWING WORDS HAVE THE MEANINGS
INDICATED.

(B)  MEDICAL TEST UNIT.

(1)  "MEDICAL TEST UNIT" MEANS ANY MOBILE OR
OTHER UNIT THAT OFFERS TO PROVIDE, WITH OR WITHOUT CHARGE,
ANY PHYSICAL OR PHYSIOLOGICAL EXAMINATION TO DETECT AN
ABNORMALITY OF THE HUMAN BODY OR ANY OF ITS FUNCTIONS.

(2)  "MEDICAL TEST UNIT" INCLUDES A UNIT THAT
OFFERS THESE EXAMINATIONS IN THIS STATE, WHETHER THE
EXAMINATION IS READ OR INTERPRETED INSIDE OR OUTSIDE OF THIS
STATE.

(C)  PERMIT.

"PERMIT" MEANS A PERMIT ISSUED BY THE SECRETARY TO
OPERATE A MEDICAL TEST UNIT.

REVISOR'S NOTE: Subsections (a) and (b) of this section
formerly appeared as Article 43, § 54K(a)(l) and
(2).

Subsection (c) of this section is new language
added to allow concise reference to a permit
issued under this subtitle.

In subsection (b)(1) of this section, the former
specific references to "bodily organs" and "any
parts" are deleted as unnecessary in light of the
general reference to the human body.

Also in subsection (b)(1) of this section, the
former references to any "laboratory examination"
and to "abnormalities of blood {and} urine" are
deleted since any unit that offers a laboratory
examination, including tests that would detect
those abnormalities, is subject to the permit
requirements under Subtitle 2 of this title.
This deletion avoids imposing a dual permit
requirement unnecessarily. It also reflects
