The defined term "Department", which refers to
the "Department of Health and Mental Hygiene", is
substituted for the obsolete reference to the
"Department of Health". See the General
Revisor's Note to this article.

In subsection (c)(2) of this section, the former
reference to rules and regulations "necessary or
desirable for ... the provisions of this article"
is deleted as overly broad in light of this
section and as otherwise unnecessary in light of
§ 2-104(b) of this article.

The only other changes are in style.

15-126. EDUCATIONAL PROGRAMS FOR HANDICAPPED CHILDREN.

THE SECRETARY SHALL PROVIDE EDUCATIONAL PROGRAMS TO
MEET THE NEEDS OF EACH PHYSICALLY OR MENTALLY HANDICAPPED
CHILD IN THE CUSTODY OF THE DEPARTMENT. THE COST FOR EACH
CHILD SHALL BE INCLUDED AND IDENTIFIED IN THE BUDGET OF THE
DEPARTMENT AS SUBMITTED TO THE GENERAL ASSEMBLY BY THE
GOVERNOR.

REVISOR'S NOTE: This section formerly appeared as
Article 43, § 12A.

The former reference to the cost being "subject
to the power of the General Assembly with respect
to budget appropriations" is deleted as
unnecessary.

The only other changes are in style.

15-127. VICTIM OF ALLEGED RAPE OR SEXUAL OFFENSE.

(A)  EXAMINATION WITHOUT CHARGE TO VICTIM.

IF A PHYSICIAN OR A HOSPITAL PROVIDES ANY PHYSICAL
EXAMINATION OF A VICTIM OF AN ALLEGED RAPE OR SEXUAL OFFENSE
TO GATHER INFORMATION AND EVIDENCE AS TO THE ALLEGED CRIME,
THESE SERVICES SHALL BE PROVIDED WITHOUT CHARGE TO THE
INDIVIDUAL.

(B)  PAYMENT BY DEPARTMENT.

THE PHYSICIAN OR HOSPITAL IS ENTITLED TO BE PAID BY THE
DEPARTMENT FOR THE COSTS OF PROVIDING THESE SERVICES.
