REVISOR'S NOTE: This section is new language derived
without substantive change from former Article
43, § 42D(e).

In subsection (a) of this section, the defined
term "Program recipient" is substituted for the
phrase "eligible recipients", for consistency.

As to licensed day care centers for the elderly
and for medically handicapped adults, see Title
14, Subtitles 3 and 4 of this article.

15-112. SAME -- PHYSICIANS.

AFTER CONSULTATION WITH THE STATE BOARD OF PHARMACY,
THE SECRETARY MAY AUTHORIZE REIMBURSEMENT OF A PHYSICIAN FOR
THE DISPENSING OF DRUGS TO PROGRAM RECIPIENTS, ON THE SAME
BASIS AS A LICENSED PHARMACIST IF:

(1)  THE PHYSICIAN DISPENSES DRUGS ON A REGULAR
BASIS IN THE PHYSICIAN'S OFFICE; AND

(2)  THERE IS NO PHARMACY WITHIN 10 MILES OF THAT
OFFICE.

REVISOR'S NOTE: This section formerly appeared as
Article 43, § 42P.

The defined term "physician", which refers to an
individual authorized to practice medicine in

this State, is substituted for the ambiguous
reference to a "licensed physician".

The only other changes are in style.

15-113. SAME'— PUBLIC INSTITUTIONS.

(A)  "INMATE OF A PUBLIC INSTITUTION" DEFINED.

IN THIS SECTION, "INMATE OF A PUBLIC INSTITUTION" HAS
THE MEANING STATED IN TITLE 42, § 435.1009 OF THE CODE OF
FEDERAL REGULATIONS (1978 EDITION).

(B)  PAYMENT REQUIRED.

(1) IF AN INMATE OF A PUBLIC INSTITUTION IS
ELIGIBLE FOR FEDERALLY FUNDED MEDICAID BENEFITS, THE
