STATES DEPARTMENT OF HEALTH AND HUMAN SERVICES APPROVES THIS
METHOD OF REIMBURSEMENT.

REVISOR'S NOTE: This section formerly appeared as
Article 43, § 42-I.

The reference to the "United States Department of
Health and Human Services" is substituted for the
obsolete reference to the "social and
rehabilitation services of the Department of
Health, Education, and Welfare", to conform to
current nomenclature.

The only other changes are in style.

15-111. SAME -- DAY CARE FOR THE ELDERLY AND MEDICALLY
HANDICAPPED ADULTS.

(A)  IN GENERAL.

THE DEPARTMENT MAY AUTHORIZE REIMBURSEMENT OF A
LICENSED DAY CARE CENTER FOR THE ELDERLY OR MEDICALLY
HANDICAPPED ADULTS FOR MEDICAL CARE THAT THE CENTER PROVIDES
TO A PROGRAM RECIPIENT WHO IS CERTIFIED AS REQUIRING NURSING
HOME CARE.

(B)  LIMITATIONS.

(1)  REIMBURSEMENT UNDER THIS SECTION IS SUBJECT
TO THE AVAILABILITY OF FEDERAL FUNDS.

(2)  THE REIMBURSEMENT RATE FOR MEDICAL DAY CARE:

(I)  MAY NOT BE MORE THAN 75 PERCENT OF THE
MAXIMUM PER DIEM RATE UNDER THE PROGRAM FOR COMPREHENSIVE
LONG TERM CARE FACILITIES; AND

(II)  SHALL BE ON A COST RELATED BASIS AND
SHALL INCLUDE COSTS AS REQUIRED FOR THE FOLLOWING:

1.  ADMINISTRATIVE OVERHEAD.

2.  DRUGS, SUPPLIES, AND EQUIPMENT.

3.  FOOD.

4.  MEDICAL AND REHABILITATIVE
SERVICES.

5.  STAFF.

6.  TRANSPORTATION.
