REVISOR'S NOTE: This subsection is new language derived
without substantive change from former Article
43, § 717H(a) and rephrased in the standard
introductory language to a definition section.

(B)  DAY CARE CENTER FOR ADULTS.

"DAY CARE CENTER FOR ADULTS" MEANS A PLACE THAT:

(1)  IS OPERATED TO PROVIDE, WITH OR WITHOUT
CHARGE, CARE FOR MEDICALLY HANDICAPPED ADULTS; AND

(2)  EITHER IS:

(I)  DESIGNATED FOR GROUP DAY CARE FOR 4 OR
MORE MEDICALLY HANDICAPPED ADULTS; OR

(II)  A FAMILY HOME THAT PROVIDES DAY CARE
FOR 2 OR 3 MEDICALLY HANDICAPPED ADULTS.

REVISOR'S NOTE: This subsection formerly appeared as
Article 43, § 717H(b).

In item (2) of this subsection, the words "either
is" are substituted for "and includes" since item
(2)(i) and (ii) of this subsection seems to
contain additional qualifications for
characterization as a day care center for adults,
rather than mere examples of places that are . day
care centers.

The only other changes are in style.

As to item (2)(i) of this subsection, the

Commission to Revise the Annotated Code notes,
for consideration by the General Assembly, that,
while this provision refers to places
"designated" for group care, there is no
provision specifying by whom the place must be
designated.

Defined term:

"Medically handicapped adult" § 14-301

(C)  MEDICALLY HANDICAPPED ADULT.

"MEDICALLY HANDICAPPED ADULT" MEANS AN INDIVIDUAL WHO:

(1)  IS 16 YEARS OLD OR OLDER;

(2)  LIVES ALONE OR WITH A SPOUSE, RELATIVE, OR
FRIEND; AND

(3) HAS A DISABILITY THAT IS:
