14-206. PLANS, RULES, AND REGULATIONS.

(A)  RULES AND REGULATIONS.

THE DEPARTMENT SHALL ADOPT RULES AND REGULATIONS THAT
SET THE STANDARDS NECESSARY FOR THE WELFARE AND SAFETY OF
ELDERLY INDIVIDUALS WHO RECEIVE CARE IN DAY CARE CENTERS FOR
THE ELDERLY.

(B)   SUBMISSION TO OFFICE ON AGING.

BEFORE THE DEPARTMENT ADOPTS A PROPOSED PLAN, RULE, OR
REGULATION UNDER THIS SUBTITLE, THE DEPARTMENT SHALL SUBMIT
THE PLAN, RULE, OR REGULATION TO THE OFFICE ON AGING FOR ITS
RECOMMENDATIONS.

REVISOR'S NOTE: This section formerly appeared as the
second sentence of Article 43, § 717C(a) and the
second clause of the first sentence of (b).

In subsection (a) of this section, the term
"welfare" is substituted for "best interests",
for clarity.

The only other changes are in style.

The second sentence of former Article 43, §
717C(b), which specified that the rules and
regulations have "the force of law", is deleted
as unnecessary since;, absent a provision to the
contrary, this is the effect given rules and
regulations.
