The Commission to Revise the Annotated Code
notes, for consideration by the General Assembly,
that, in addition to this subtitle and the
provisions for licensed family care homes, other
provisions for young children outside of their
homes appear in: (1) Article 88A, §§ 19 through
32 of the Code, which relate to child care homes
and institutions; (2) ED § 2-206, which relates
to noncollegiate educational institutions; and
(3) Title 6, Subtitle 1 of this article, which
relates to care of certain juveniles.

The Commission also notes that a clearer
statement of the relationship of this subtitle to
the rights and powers of the State Social
Services Administration and the State and county
departments of education may be warranted.

See also ED § 7-109, which requires a county
board of education to give priority to a
nonprofit group day care center for the use of
school facilities.

14-104. RULES AND REGULATIONS.

(A)   IN GENERAL.

THE SECRETARY SHALL ADOPT RULES AND REGULATIONS FOR
LICENSING AND OPERATING GROUP DAY CARE CENTERS.

(B)  CONTENTS.

THESE RULES AND REGULATIONS SHALL:

(1)  ENSURE SAFE AND SANITARY CONDITIONS IN GROUP
DAY CARE CENTERS;

(2)  ENSURE PROPER CARE, PROTECTION, AND
SUPERVISION OF CHILDREN IN GROUP DAY CARE CENTERS;

(3)  PROMOTE THE SOUND GROWTH AND DEVELOPMENT OF
CHILDREN IN GROUP DAY CARE CENTERS; AND

(4)  CARRY OUT OTHERWISE THE PURPOSES AND
REQUIREMENTS OF THIS SUBTITLE.
