separately in former Article 43, § 708(6),
appeared only in the definition of "group day
care center" in former Article 43, § 708(4).
Therefore, in this subsection, the word
"establishment" is added to incorporate the
substance of former Article 43, § 708(6). The
description in former Article 43, § 708(6) that
an establishment is "of public or private
character" or "affect{s} a community" is
deleted as superfluous.
Former Article 43, § 708(4)(ii), which provided
that family day care homes are not included, now
appears in § 14-105 of this subtitle.
The Commission to Revise the Annotated Code
notes, for consideration by the General Assembly,
that this definition of "group day care center"
may be inconsistent with the concepts expressed
in § 14-102(b) of this subtitle. In this
subsection, "group day care center" refers to a
body that "offers or provides group day care to
at least 5 children who do not have the same
parentage." However, § 14-102(b) of this
subtitle declares that the policy of this State
is to protect a child from the risk present if:
11"(1) The child is cared for by an individual
other than a relative or friend; and (2) Children
of more than one family are cared for together
or, on different days, use the same facilities."
Defined term: "Child" § 14-101
(D) LICENSE.
"LICENSE" MEANS A LICENSE ISSUED BY A HEALTH OFFICER TO
OPERATE A GROUP DAY CARE CENTER.

to allow concise reference to a license issued
under this subtitle.
