43, § 790.

Since the former statement that funds "shall be"
appropriated is not of binding effect, this
section is restated to require a request for
budget support. This change reflects actual
Department practice.

REVISOR'S NOTE TO SUBTITLE: The Commission to Revise
the Annotated Code notes, for consideration by
the General Assembly, that Article 81, § 326(l-1)
and HO § 12-603(h)(3) refer specifically to the
distribution of hemodialysis drugs and devices to
those individuals using kidney machines at home.
Under current medical practice, there are other
forms of "dialysis" -- i.e., dialysis by kidney
machine, intermittent peritoneal dialysis, and
chronic ambulatory peritoneal dialysis. The
General Assembly may wish to reconsider the scope
of Article 81, § 326(l-1) and HO § 12-603 in
light of this practice.

SUBTITLE 4. PHYSICAL FITNESS.

13-401. DEFINITIONS.

(A)   IN GENERAL.

IN THIS SUBTITLE THE FOLLOWING WORDS HAVE THE MEANINGS
INDICATED.

REVISOR'S NOTE: This subsection is new language used as
the standard introductory language to a
definition section.

(B)  COUNTY COMMISSION.

"COUNTY COMMISSION" MEANS A COMMISSION ON PHYSICAL
FITNESS FOR A COUNTY.

REVISOR'S NOTE: This subsection is new language added
to allow concise reference to a county commission
without confusion with the State Commission.

Under § 13-410 of this subtitle, a commission is
created for each county.
