13-309. CERTIFICATION OF CENTERS.

THE DEPARTMENT SHALL CERTIFY A DIALYSIS OR TRANSPLANT
CENTER THAT:

(1)  MEETS THE STANDARDS THAT THE COMMISSION
ADOPTS UNDER THIS SUBTITLE; AND

(2)   IS APPROVED BY THE STATE HEALTH PLANNING AND
DEVELOPMENT AGENCY.

REVISOR'S NOTE: This section is new language derived
without substantive change from the second
sentence of former Article 43, § 785(a).

In item (2) of this section, reference to the
"State Health Planning and Development Agency" is
substituted for the obsolete reference to the
"Comprehensive Health Planning Agency of
Maryland".

13-310. ACCEPTANCE AND CERTIFICATION OF INDIVIDUALS.

(A)  ACCEPTANCE.

AN INDIVIDUAL WHO HAS A CHRONIC KIDNEY DISEASE MAY BE
ACCEPTED FOR TREATMENT IF THE INDIVIDUAL MEETS THE STANDARDS
THAT THE COMMISSION ADOPTS UNDER THIS SUBTITLE.

(B)  CERTIFICATION.

THE DEPARTMENT SHALL CERTIFY AN INDIVIDUAL FOR STATE
PAYMENTS IF THE INDIVIDUAL:

(1) IS ACCEPTED FOR TREATMENT UNDER SUBSECTION
(A) OF THIS SECTION; AND

(2) RESIDES IN THIS STATE AT THE TIME OF
CERTIFICATION.
