ONLY THE COMMISSION MAY ADOPT RULES AND REGULATIONS
UNDER THIS SUBTITLE.
REVISOR'S NOTE: This section is new language derived
without substantive change from former Article
43, § 783, the first sentence of § 785(a) and the
first sentence and second clause of the second
sentence of (b), the third sentence of § 786, and
the second sentence of § 788.
In subsection (c)(1) of this section, reference
to acceptance of an individual "for treatment" is
substituted for the reference to acceptance "into
the treatment phase of the program", for clarity.
This substitution avoids the confusion in former
Article 43, §§ 781 through 790, which contained
references such as "reimbursement programs",
"treatment programs", "treatment phase of this
program", and "the program". The rules and
regulations set standards that hospital selection
committees must apply in screening patients for
treatment. However, a selection committee is
responsible for the screening. After an
individual is accepted for treatment, the
Department is notified for purposes of certifying
reimbursement. See COMAR 10.03.01.04A.

13-308. DUTIES OF SECRETARY.
THE SECRETARY:
(1) IS RESPONSIBLE FOR THE OPERATION OF THE
KIDNEY DISEASE PROGRAM UNDER THIS SUBTITLE WITHIN THE RULES,
REGULATIONS, AND STANDARDS THAT THE COMMISSION ADOPTS;
(2) SHALL DISBURSE AND COLLECT ANY FUNDS UNDER
THIS SUBTITLE; AND
(3) SHALL KEEP THE COMMISSION INFORMED OF:
(I) THE PROGRESS OF THE KIDNEY DISEASE
PROGRAM; AND
(II) ANY NEED FOR A CHANGE IN ITS RULES,
REGULATIONS, OR STANDARDS.

second sentence of Article 43, § 786.
In items (1) and (3)(i) of this section, the
phrase "the kidney disease program" is
substituted for "this program" and "the program"
