legislative findings in, § 13-102(10) of this
subtitle and is added to state the requirement
clearly.

As to subsection (e)(2) of this section, the
Commission to Revise the Annotated Code notes,
for consideration by the General Assembly, that
the prohibition against "testing" may not
encompass a "treatment" for a hereditary
disorder.

13-110. DUTIES OF SECRETARY.

THE SECRETARY:

(1)  IS RESPONSIBLE FOR THE OPERATION OF
HEREDITARY DISORDER PROGRAMS WITHIN THE RULES, REGULATIONS,
AND STANDARDS THAT THE COMMISSION ADOPTS;

(2)  SHALL DISBURSE AND COLLECT ANY FUNDS
AVAILABLE TO THE COMMISSION;

(3)  SHALL ENFORCE THE RULES, REGULATIONS, AND
STANDARDS THAT THE COMMISSION ADOPTS; AND

(4)  THROUGH THE EXECUTIVE DIRECTOR, SHALL KEEP
THE COMMISSION INFORMED OF:

PROGRAMS; AND

(I) THE PROGRESS OF HEREDITARY DISORDER

(II) ANY NEED FOR A CHANGE IN ITS RULES,
REGULATIONS, AND STANDARDS.

REVISOR'S NOTE: This section formerly appeared as
Article 43, § 820(a), (b), (c), and the first
sentence of (d).

In item (1) of this section, reference to
operation within the "rules" and "regulations" is
added for clarity.

The only other changes are in style.

The first sentence of former Article 43, § 820,
which required the Secretary to designate
personnel, is deleted as unnecessary in light of
the responsibilities and duties under this
section.
