The Commission to Revise the Annotated Code
notes, for consideration by the General Assembly,
that inclusion of 2 legislators on the Commission
on Hereditary Disorders as voting members may be
in contravention of Article 8 of the Maryland
Declaration of Rights, which requires separation
of powers among the branches of government, and
Article III, § 11 of the State Constitution,
which makes an individual holding a civil office
ineligible to serve in the General Assembly. See
61 Op. Att'y Gen. 152 (1976).

The second sentence of former Article 43, §
815(b), which related to the manner of
appointment, is deleted as surplusage.

13-105. OFFICERS.

FROM AMONG ITS VOTING MEMBERS, THE COMMISSION SHALL
ELECT EVERY 2 YEARS A CHAIRMAN AND A VICE CHAIRMAN.

REVISOR'S NOTE: This section is new language derived
without substantive change from the fifth
sentence of former Article 43, § 815(e).

The word "voting" is added since the rest of
former Article 43, § 815(e) appeared to apply
only to the 11 voting members.

The former reference to election by "majority
vote" is deleted as unnecessary.

The fourth sentence of former Article 43, §
815(e), which provided for the first Commission
chairman, is deleted as obsolete.

The sixth sentence of former Article 43, §
815(e), which enabled these officers to succeed
themselves, is deleted as unnecessary. As a
general rule, the right to serve successive terms
is not limited, absent an express provision to
the contrary.
