MAY NOT DISCLOSE ANY RECORD THAT THE FACILITY KEEPS ON AN
INDIVIDUAL WHO HAS BEEN TREATED IN ADMITTED TO THE FACILITY.

(2) ON REQUEST, A FACILITY SHALL DISCLOSE A
RECORD OF AN INDIVIDUAL TO THE DIRECTOR OR A DESIGNEE OF THE
DIRECTOR.

REVISOR'S NOTE: This section is new language derived
without substantive change from former Article
59, §§ 19 and 30(d)(2).

In subsection (a)(1) of this section, the
reference to "under this title" is substituted
for "under ... this subtitle", to encompass
emergency admissions which, in former Article 59,
appeared in a subtitle separate from the
provisions on voluntary and involuntary
admissions.

Similarly, in subsection (a)(2) of this section,
the reference "by this title" is substituted for
"by this article", although the latter reference
encompassed individuals committed under the
insanity and incompetency provisions since they
were not individuals for whom records were
required under subsection (a)(1) of this section.

Subsection (c) of this section is revised to
prohibit any but authorized disclosures.

SUBTITLE 8. RELEASE AND TRANSFERS.

10-801. "RELEASE" DEFINED.

IN THIS SUBTITLE, "RELEASE" MEANS A PERMANENT,
TEMPORARY, ABSOLUTE, OR CONDITIONAL RELEASE OF AN INDIVIDUAL
FROM A RESIDENTIAL FACILITY OR A VETERANS' ADMINISTRATION
HOSPITAL.

REVISOR'S NOTE: This section is new language derived
without substantive change from former Article
59, § 3(j).

The word "residential" is. added for clarity.

The former phrase "by and with the consent of
someone having authority to consent to such
departure" is deleted as unnecessary in light of
the substantive provisions of this subtitle.
