(1)  ANY INFORMATION THAT THE ADMINISTRATIVE HEAD
HAS ABOUT AN INDIVIDUAL IN THE FACILITY;

(2)  ACCESS TO THE INDIVIDUAL; AND

(3)  ACCESS TO ANY PART OF THE FACILITY.

REVISOR'S NOTE: This section formerly appeared as
Article 59, § 30(d)(1), (3), and (4).

In the introductory clause of this section, the
reference "public or private, in which mentally
disordered persons are patients," which formerly
modified "facility", is deleted as unnecessary.

In the introductory clause and item (1) of this
section, the term "administrative head" is
substituted for "superintendent", to standardize
the references to this type of position.

In item (3) of this section, the former reference
to a part of a facility "used for or in
conjunction with the care, maintenance,
sustenance or treatment of such patients" is
deleted as unnecessary in light of the use of the
defined term "facility".

The only other changes are in style.

10-709. RECORDS.

(A)  REQUIRED RECORDS.

(1)  EACH FACILITY SHALL KEEP COMPLETE RECORDS
FOR EACH INDIVIDUAL WHO IS TREATED IN ADMITTED TO THE
FACILITY UNDER THIS TITLE.

(2)  THE RECORDS SHALL CONTAIN ALL OF THE
INFORMATION THAT IS REQUIRED BY THIS TITLE OR THE
ADMINISTRATION.

(B)  STORAGE.

A FACILITY SHALL KEEP THE RECORDS IN A SEPARATE AND
SECURE AREA AT THE FACILITY.

(C)  DISCLOSURE.

(1) EXCEPT AS PROVIDED IN § 9-109 OF THE COURTS
ARTICLE OR IN PARAGRAPH (2) OF THIS SUBSECTION, A FACILITY
