(II)  MADE A PERMANENT PART OF THE
INDIVIDUAL'S RECORD.

(2) IF THE ATTENDING PHYSICIAN BELIEVES THAT,
BECAUSE OF THE CONDITION OF AN INDIVIDUAL, ANOTHER
INDIVIDUAL SHOULD BE PERMITTED TO BE PRESENT WHEN WRITING
INSTRUMENTS ARE USED, THE PERMISSION SHALL BE:

(I)  SIGNED BY THE ATTENDING PHYSICIAN; AND

(II)  MADE A PERMANENT PART OF THE
INDIVIDUAL'S RECORD.

REVISOR'S NOTE: This section is new language derived
without substantive change from former Article
59, § 50(a), (b), and (c).

In subsections (a)(1) and (b) of this section,
the former references to a facility "licensed by
or under the jurisdiction of the Department" are
deleted as unnecessary.

Subsection (b) of this section is revised to
require an individual to state an unwillingness
to receive calls, rather than the former
requirement to state a willingness to receive a
call.

The Commission to Revise the Annotated Code
notes, for consideration by the General Assembly,
that under subsection (a)(1) of this section, the
right to correspond is subject to any "reasonable
limitation". The General Assembly may wish to
set more specific standards or otherwise clarify
this paragraph, by, e.g., restricting threatening
letters.

10-702. VISITORS.

(A) IN GENERAL.

EACH INDIVIDUAL IN A FACILITY OR A VETERANS'
ADMINISTRATION HOSPITAL SHALL BE ENTITLED TO RECEIVE VISITS:

(1) AT ALL REASONABLE HOURS, FROM A LAWYER THAT
THE INDIVIDUAL CHOOSES;

(2) AT ALL REASONABLE HOURS, FROM A CLERGYMAN
THAT THE INDIVIDUAL CHOOSES; AND
