REVISOR'S NOTE; Subsection (a) of this section is new
language added for clarity.

Subsection (b) of this section is new language
derived without substantive change from the
second sentence of former Article 41, §
206A(c)(l), as that sentence related to
involuntary admissions to a mental health
facility.

The Commission to Revise the Annotated Code
notes, for consideration by the General Assembly,
that, while this section clearly indicates that a
hearing on an involuntary admission is held, only
§ 10-632 sets out any provisions for this
hearing. Cf., § 7-505 of this article, as to
admission hearings under the Mental Retardation
Law. Under Departmental rules, a hearing on an
involuntary admission under this subtitle is held
within 5 working days. See COMAR 10.01.01.03.

SUBTITLE 7. RIGHTS OF INDIVIDUALS IN FACILITIES.

10-701. COMMUNICATIONS.

(A)  CORRESPONDENCE.

(1)  SUBJECT TO ANY REASONABLE LIMITATION THAT A
FACILITY OR VETERANS' ADMINISTRATION HOSPITAL IMPOSES, EACH
INDIVIDUAL IN THE FACILITY OR HOSPITAL SHALL HAVE AVAILABLE,
AT ALL REASONABLE HOURS, WRITING INSTRUMENTS, STATIONERY,
AND POSTAGE AND MAY USE THEM TO WRITE TO ANYONE.

(2)  THE CORRESPONDENCE OF THE INDIVIDUAL SHALL
BE SENT TO THE ADDRESSEE WITHOUT DELAY, AND EXCEPT UNDER THE
DIRECTION OF THE ADDRESSEE, WITHOUT BEING OPENED.

(B)  TELEPHONE.

EACH INDIVIDUAL IN A FACILITY OR IN A VETERANS'
ADMINISTRATION HOSPITAL SHALL HAVE ACCESS, AT ALL REASONABLE
HOURS, TO A TELEPHONE AND MAY TELEPHONE ANYONE WHO HAS NOT
GIVEN THE FACILITY OR HOSPITAL WRITTEN NOTICE OF BEING
UNWILLING TO BE TELEPHONED.

(C)  RESTRICTIONS.

(1) IF, FOR MEDICAL OR ADMINISTRATIVE REASONS,
ACCESS TO WRITING INSTRUMENTS OR TELEPHONES IS LIMITED, THE
LIMITATION SHALL BE:
