property located in the Special Taxing District for the
purpose of paying the principal of and interest on any bonds
of the City issued for the purpose of financing the
construction of a pedestrian mall within the central
business district of the City; and
WHEREAS Ordinance No. 2742 as amended by Ordinance No.
2819 authorizes and directs the City annually to levy a tax
upon property within the Special Taxing District in rate and
amount sufficient to pay the debt service on the pro rated
portion of outstanding Cumberland Parking Facilities Bonds
of 1973 the proceeds of which have been used and applied to
finance the cost of the Cumberland Mall; and
WHEREAS the Mayor and City Council further find it
necessary and desirable in the public interest, in order
fairly to distribute the burden of the cost of operating the
Cumberland Mall, that taxes should be levied upon properties
within the Special Taxing District in an amount sufficient
to pay the costs of operating the Cumberland Mall;

RESOLUTION NO. 82
RESOLUTION of the Mayor and City Council of Cumberland,
Maryland, adopted pursuant to the authority contained in
Article 11-E of the Constitution of the State of Maryland
and Section 12 of Article 23A of the Annotated Code of
Maryland, entitled "Municipal Corporations", as said Section
was enacted by Chapter 423 of the Acts of the General
Assembly of Maryland, 1955, entitled "A RESOLUTION TO AMEND
THE CHARTER OF THE CITY OF CUMBERLAND, MARYLAND (1966
EDITION), BY REPEALING AND REENACTING, WITH AMENDMENTS,
SECTION 55 OF SAID CHARTER."
[Section 55 of the Charter of the City of Cumberland,
Allegany County, repealed and reenacted, with amendments.
