Subsections (a)(2), (b), and (c) of this section
are new language derived without substantive
change from former Article 59, § 9(c)(2), (f),
and the first sentence of (e).

In subsection (b)(2) of this section, the
reference to the "State budget" is substituted
for the reference to "available funds", for
clarity and conformity.

Also in subsection (b)(2) of this section, the
former reference to reimbursement for expenses
"actually and necessarily incurred in the
performance of duties" is deleted as unnecessary
in light of the reference to Standard State
Travel Regulations. Standard State Travel
Regulations are adopted by the Department of
Personnel with the approval of the Board of
Public Works.

In subsection (c) of this section, the reference
to "other staff services" is substituted for the
ambiguous reference to "housekeeping", to conform
to practice.

The Commission to Revise the Annotated Code
notes, for consideration by the General Assembly,
that there is no quorum provision. In the
absence of an express provision, rule, or
regulation, case law indicates that a majority of
the members is a quorum. See Gemeny v. Prince
George's County, 264 Md. 85 (1972); Zeiler v.
Central Ry., 84 Md. 304 (1896); and Heiskell v.
Mayor of Baltimore, 65 Md. 125 (1886).

10-305. DUTIES.

THE STATE ADVISORY COUNCIL SHALL:

(1)   SUBMIT AN ANNUAL REPORT ON ITS ACTIVITIES TO
THE GOVERNOR AND THE GENERAL ASSEMBLY;

(2)  ADVISE THE ADMINISTRATION GENERALLY ON
CARRYING OUT THE PROVISIONS OF THIS TITLE; AND

(3)  BE A STRONG ADVOCATE OF A COMPREHENSIVE,
BROAD-BASED APPROACH TO THE SOCIAL, ECONOMIC, AND MEDICAL
PROBLEMS OF MENTAL HYGIENE.
