article, which also is derived from former
Article 59, § 39(f) and (g) -- the substance of
former Article 59, § 3(f) is incorporated into
the definition of "mental disorder". In § 10-514
et seq. of this title, which are derived, in
part, from former Article 59, §§ 58, 59, 60, and
62, the term "mental disorder" is substituted for
"mental illness" and "mentally ill". Therefore,
a separate definition of "mental illness" no
longer is needed.
The second sentence of former Article 59, § 3(g),
which stated that the "term {mental illness}
shall replace the words 'insane,' 'insanity,'
'lunacy,' 'mentally sick,' 'mental disease,'
'unsound mind' and similar words as they appear
in the statutes of the State of Maryland", is
deleted. The Commission to Revise the Annotated
Code believes that the sentence was intended as a
statement of policy -- calling for the
elimination of demeaning terms -- rather than a
directive to make this substitution. The
Commission notes that, except as indicated above,
the term "mental disorder" rather than "mental
illness" was used throughout former Article 59.
The Commission also notes that "insanity" is
still a valid term, particularly in criminal law.
The terms "lunacy" and "mentally sick" appeared
in the public general laws of this State only in
former Article 59, § 3(g).
For the purposes of Subtitle 6, Part IV of this
title, which relates to emergency admissions, the
term "mental disorder" is defined differently.

(G) STATE ADVISORY COUNCIL.
"STATE ADVISORY COUNCIL" MEANS THE STATE ADVISORY
COUNCIL ON MENTAL HYGIENE.
REVISOR'S NOTE: This subsection is new language added
to avoid repetition of the full title "State
Advisory Council on Mental Hygiene".
(H) STATE FACILITY.
"STATE FACILITY" MEANS A FACILITY THAT IS MAINTAINED
UNDER THE DIRECTION OF THE ADMINISTRATION OWNED OR OPERATED
BY THE DEPARTMENT.
