PROCEEDING.

(C) EVIDENCE AND RESULTS OF PROCEEDING.

THE RESULTS OF A PROCEEDING TO COMMIT AN INDIVIDUAL
UNDER SUBTITLE 6 OF THIS TITLE AND EVIDENCE IN THE
PROCEEDING MAY NOT BE USED AGAINST THAT INDIVIDUAL IN ANY
OTHER PROCEEDING.

REVISOR'S NOTE: This section is new language derived
without substantive change from former Article
43B, § 10(b) and the second sentence of (a).

In subsection (a) of this section, the former
cross-reference to an "educator pursuant to the
provisions of § 7-410 of the Education Article"
is deleted as unnecessary in light of the
referenced provision of the Education Article,
which protects the statements of a student and
conclusions of the educator in the course of drug
abuse counseling.

SUBTITLE 9. PROHIBITED ACT; PENALTIES.

9-901. UNLAWFUL OR IMPROPER ADJUDICATION AS DRUG ADDICT.

(A)  IN GENERAL.

A PERSON MAY NOT KNOWINGLY HAVE OR ATTEMPT TO HAVE AN
INDIVIDUAL UNLAWFULLY OR IMPROPERLY ADJUDGED A DRUG ADDICT
UNDER SUBTITLE 6 OF THIS TITLE.

(B)  PENALTY.

A PERSON WHO VIOLATES ANY PROVISION OF THIS SECTION IS
GUILTY OF A MISDEMEANOR AND ON CONVICTION IS SUBJECT TO A
FINE NOT EXCEEDING $1,000 OR IMPRISONMENT NOT EXCEEDING 3
YEARS OR BOTH.

43B, § 11.

In subsection (a) of this section, the phrase
"have or attempt to have" is substituted for the
