5014                                              VETOES

Maryland, their agents or contractors, nor to the repair or
maintenance of electrical power plants and systems owned or
operated by private companies or corporations, which produce
or generate electricity for their own use.]

63.

    (A) IN THIS SECTION, "CONTRACTOR" MEANS A CONTRACTOR

WHO HAS PERFORMED CONSTRUCTION AND MAINTENANCE WORK ON
HIGH VOLTAGE LINES FOR AT LEAST 100 HOURS IN ANY 6-MONTH
PERIOD AND WHO HAS A REPUTATION FOR EXPERTISE IN THIS AREA.

(A) (1) IN THIS SECTION, "CONTRACTOR" MEANS A PERSON
WHO AGREES TO PERFORM CONSTRUCTION, REPAIR, OR MAINTENANCE
WORK ON HIGH VOLTAGE LINES OR TELEPHONE LINES.

(2) A CONTRACTOR SHALL HAVE PERFORMED AT LEAST
100 HOURS CONSTRUCTION, REPAIR, OR MAINTENANCE WORK IN ANY 6
MONTH PERIOD AND HAVE A REPUTATION FOR EXPERTISE IN THE AREA
TO QUALIFY FOR THE EXEMPTION UNDER THIS SUBTITLE.

(B)  THIS SUBTITLE DOES NOT APPLY TO:

(1)  THE CONSTRUCTION, OPERATION, OR MAINTENANCE
OF HIGH-VOLTAGE LINES OR TELEPHONE LINES, THEIR SUPPORTING
STRUCTURES, OR ASSOCIATED EQUIPMENT BY PUBLIC UTILITIES
REGULATED BY THE PUBLIC SERVICE COMMISSION OF MARYLAND;

(2)  CONTRACTORS OF THESE PUBLIC UTILITIES WHILE
PERFORMING CONSTRUCTION ON MAINTENANCE WORK ON HIGH-VOLTAGE
LINES OR TELEPHONE LINES; OR

(3)  THE CONSTRUCTION, REPAIR, OR MAINTENANCE OF
ELECTRICAL POWER PLANTS AND OR SYSTEMS OWNED OR OPERATED BY
PRIVATE COMPANIES OR CORPORATIONS WHICH PRODUCE OR,
GENERATE, OR DISTRIBUTE ELECTRICITY FOR THEIR OWN USE AND
HAVE A REPUTATION FOR EXPERTISE IN THIS AREA . ; OR

(4) THE CONSTRUCTION AND MAINTENANCE OF TRAFFIC
SIGNALS, HIGHWAY SIGNS, HIGHWAY LIGHTING, AND ALL SUPPORTING
STRUCTURES AND ASSOCIATED EQUIPMENT.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1982.
