CHAPTER 910

(House Bill 1479)

AN ACT concerning

Caroline County - Draining Land

FOR the purpose of authorizing the Caroline County
Commissioners to appoint a board of drainage viewers to
evaluate changes in land use upon request by the board
of managers; authorizing the board of managers to use
the evaluation report as a basis to levy the necessary
tax to maintain drainage improvements; and clarifying
language.

BY repealing and reenacting, with amendments,

Article 25 - County Commissioners

Section 87

Annotated Code of Maryland

(1981 Replacement Volume and 1981 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
read(s) as follows:

Article 25 - County Commissioners

87.

(A)  All drainage improvements constructed under [this
subtitle] ARTICLE 25, §§ 52 THROUGH 95 shall be under the
control and supervision of the board of managers. It shall
be the duty of the [said] board to keep the [said] drainage
improvements in good repair[, and for this purpose they].

(B)  THE BOARD OF MANAGERS may at any time levy a
[drainage] tax FOR DRAINAGE IMPROVEMENTS MAINTENANCE on the
lands benefited [in the same manner and in the same
proportion as the original drainage taxes were levied for
the construction of the improvements. Such]. [taxes] TAXES
for maintenance purposes shall be levied, collected and
disbursed in the same manner AND PROPORTION as [hereinbefore
provided for] WERE the original taxes FOR DRAINAGE
IMPROVEMENTS.

(C) IF THE BOARD OF MANAGERS REQUESTS, THE COUNTY
COMMISSIONERS MAY APPOINT A BOARD OF DRAINAGE VIEWERS TO
