the modification shall provide for reimbursing the
commission for such substantial net additional costs or
expenses.

SECTION 2 3. AND BE IT FURTHER ENACTED, That this

Act shall take effect July 1, 1982.

SECTION 3. AND BE IT FURTHER ENACTED, That Section(s)
l-204(d) and (e), respectively, of Article 67 - Washington
Suburban Sanitary District, of the Annotated Code of
Maryland be renumbered to be Section(s) l-204(e) and (f),
respectively.

SECTION 4. AND BE IT FURTHER ENACTED, That Section(s)
of the Annotated Code of Maryland (as enacted by

Chapter_______(H.B. 1802) of the Acts of the General Assembly

of 1982) read(s) as follows:

Article 67 - Washington Suburban Sanitary District

1-204.

(D) ANY ITEM OF EXPENSE IN EITHER BUDGET FOR A
STORMWATER MANAGEMENT PROJECT THAT SERVES ONLY 1 COUNTY AND
IS FUNDED SOLELY BY THAT COUNTY IS NOT SUBJECT TO APPROVAL
OR MODIFICATION BY THE COUNTY THAT IS NOT SERVED BY THE
STORMWATER MANAGEMENT PROJECT.

7-105.

(e)(1) If the WSSC's submitted statement of objectives
with respect to a major project to be constructed in whole
or in part in one county declares that the project is
designed to provide services in whole or in substantial part
to the other county, the major project may be disapproved
with the concurrence of the Montgomery County Council or the
Prince George's County governing body, depending on the
county that is to receive the designed services.

(2) (i) Notwithstanding paragraph (1) of this
subsection, the Montgomery County Council or the Prince
George's County governing body, depending on the county
where the project is located, may direct modifications in
location or change the proposed year of construction if the
modification or change will not prevent the services being
available when needed.

(II) IF A STORMWATER MANAGEMENT PROGRAM IS
INCLUDED IN THE WSSC CAPITAL IMPROVEMENTS PROGRAM AND THE
PROGRAM SERVES ONLY 1 COUNTY AND IS FUNDED SOLELY BY THAT
COUNTY, THE PROGRAM OR AMENDMENTS TO THE PROGRAM ARE NOT
SUBJECT TO APPROVAL BY THE COUNTY THAT IS NOT SERVED.
