LAWS OF MARYLAND

Ch. 878

Preamble

WHEREAS, The Fort Washington Marina on Piscataway Creek
serving the Potomac River is an invaluable asset to the
citizens of Prince George's County and of Maryland; and

WHEREAS, The Department of Natural Resources has a
policy of establishing boating centers throughout the State;
and

WHEREAS, The Washington metropolitan area is one of the
largest population centers in Maryland; and

WHEREAS, The Department of Natural Resources currently
does not own a marina on the Potomac River, which river is
Maryland property; and

WHEREAS, The Fort Washington Marina is an established
marina and therefore will require a minimum expense to
acquire, as compared to the expense of building a new
marina; and

WHEREAS, The National Park Service has made the Fort
Washington Marina available to the State of Maryland; and

WHEREAS, The National Park Service is better able to
get a dredging permit than the State of Maryland, and the
lack of a permit is obstructing the transfer of the Fort
Washington Marina to the State; now, therefore,

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That:

(1)  The State of Maryland shall assume ownership from
the National Park Service, the property known as Fort
Washington Marina on Piscataway Creek in Prince George's
County, Maryland.

(2) The State of Maryland shall secure a permit from
the National Park Service on an approved spoil site located
on National Park Service land adjacent to the south shore of
Piscataway Creek, or that, failing this, the State shall
fully investigate and document alternative spoil site
locations.

(2) (3) The State of Maryland shall assume ownership
of the marina, contingent upon a secured permit from the
Army Corps of Engineers through the National Park Service
and the appropriation of sufficient funding in the fiscal
year 1984 State Budget to meet the expected State
expenditures for revitalizing the marina.
