SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That Section(s) 40(c), (d), (e), and (f),
respectively, of Article 2B - Alcoholic Beverages, of the
Annotated Code of Maryland be renumbered to be Section(s) 40
(d), (e), (f), and (g), respectively.

SECTION 2. AND BE IT FURTHER ENACTED, That section(s)
of the Annotated Code of Maryland read(s) as follows:

Article 2B - Alcoholic Beverages

40.

(C) (1) IN HOWARD COUNTY THE APPLICANTS FOR A NEW
LICENSE OR THE TRANSFER OF AN EXISTING LICENSE FOR THE USE
OF A CORPORATION SHALL CERTIFY THAT THE FOLLOWING
REQUIREMENTS SHALL BE MAINTAINED AS LONG AS THE LICENSEE IS
THE HOLDER OF THE LICENSE:

(I)  THAT THE QUALIFYING INDIVIDUAL OWNS A
MINIMUM OF 10 PERCENT OF THE STOCK IN THE CORPORATION; OR

(II)  THAT THE QUALIFYING INDIVIDUAL SHALL
SERVE AS THE MANAGER OR SUPERVISOR AND SHALL BE PHYSICALLY
PRESENT ON A FULL TIME BASIS AT THE LICENSED PREMISES TO
CONDUCT THE DAILY BUSINESS INVOLVING TRANSACTIONS CONCERNING
ALCOHOLIC BEVERAGES SALES.

(2) THE STOCK OWNERSHIP REQUIREMENT PROVIDED FOR
IN PARAGRAPH (1) OF THIS SUBSECTION DOES NOT APPLY:
