REVISOR'S NOTE: This section is new language derived
without substantive change from the third,
fourth, sixth, and seventh sentences of former
Article 43B, § 9(f) and restated as the rights of
the individual.

9-606. CONFIDENTIALITY OF PROCEEDINGS.

(A)  CLOSED SESSIONS.

UNLESS THE INDIVIDUAL FOR WHOM COMMITMENT IS SOUGHT
ASKS OTHERWISE, THE COURT SHALL HOLD THE PROCEEDING IN
CLOSED SESSION.

(B)  PAPERS.

THE COURT SHALL ORDER ALL PAPERS IN THE PROCEEDING TO

BE:

(1)   SEALED; AND

(2)   SHOWN ONLY TO A PARTY TO THE PROCEEDING OR,
ON ORDER OF THE COURT, TO ANY OTHER PERSON WHO PROPERLY IS
INTERESTED IN THE PROCEEDING.

REVISOR'S NOTE: This section is new language derived
without substantive change from former Article
43B, § 9(p).

In subsection (a) of this section, the former
requirement that the proceeding be "private" is
deleted as unnecessary in light of the reference
to a "closed session".

In subsection (b) of this section, the former
provision for an order that papers in a
commitment proceeding be filed with the clerk's
office is deleted as unnecessary.

As to the confidentiality of the results of these
proceedings and evidence in them, see § 9-802 of
this title.

9-607. DETENTION PENDING PROCEEDINGS.

(A) DETENTION AUTHORIZED.

IN AN APPROPRIATE CASE, A COURT MAY DIRECT THAT,
PENDING A PROCEEDING UNDER THIS SUBTITLE, AN INDIVIDUAL FOR
WHOM COMMITMENT IS SOUGHT IS TO BE HELD IN A DETENTION
FACILITY THAT THE ADMINISTRATION DESIGNATES.

(B) RIGHTS OF DETAINEE.
