use of any other person, either with or without the written
order or consent of the parent or guardian of such minor THE
PERSON[; any].
(2) ANY person violating the provisions of this
subsection shall be deemed guilty of a misdemeanor, and upon
conviction [thereof] shall be fined [a sum] not less than
[twenty-five dollars] $25 nor more than [one hundred
dollars] $100, or be imprisoned in jail for not less than
[ten] 10 days, nor more than [sixty] 60 days, or be both
fined and imprisoned in the discretion of the court[;]. [but
if]
(3) IF any minor UNDERAGE PERSON [shall]
wilfully [represent] REPRESENTS that he is of full age and
[thereby shall obtain] OBTAINS any spirituous liquors, and
the person selling the [same shall be] SPIRITUOUS LIQUOR IS
able to prove at [his or her] THE trial such
misrepresentation, and that [he or she used] due caution WAS
USED in ascertaining the age of such minor THE UNDERAGE
PERSON [before disposing of the liquor as aforesaid to said]
BEFORE GIVING THE ALCOHOL TO THE minor UNDERAGE PERSON and
that in the exercise of reasonable caution he was deceived
by the use of documentary evidence and that for [such] THIS
reason he was unable to ascertain that the minor UNDERAGE
PERSON was in fact a minor AN UNDERAGE PERSON, then the
person [so] selling to [such] THE minor UNDERAGE PERSON,
shall be acquitted of the [said] charge[, the minor
obtaining spirituous liquor by such misrepresentation of his
or her age shall be guilty of a misdemeanor and upon trial
and conviction shall be sentenced to pay a fine of not less
than ten dollars, nor more than twenty dollars and the costs
of his prosecution. Any fines or costs shall be paid
pursuant to the provisions of Article 38, § 4].
122.
In Charles County no licensee and no agent, servant or
employee of said licensee shall be permitted to sell any
alcoholic beverages except in a room having one or more
plain glass windows or doors so as to enable persons
standing on the outside to observe the interior of the
premises at all hours, and no curtain, blind, screen or
other obstruction shall be placed before such windows, or
doors. Any [person] LICENSEE violating any of the
provisions of this section shall be deemed guilty of a
misdemeanor and upon trial and conviction shall be subjected
to a fine of not less than [fifty dollars] $50 nor more than
[two hundred and fifty dollars] $250, or may be confined in
the county jail or in the house of correction for not less
than [sixty] 60 days or both, in the discretion of the
court.
