Ch. 844

[ 403.

Any person under the age of twenty-one years, except
where beer or light wine is involved, any person under the
age of eighteen years, who shall knowingly and falsely
represent himself to be twenty-one years of age, or eighteen
years of age where beer or light wine is involved, to any
licensed innkeeper or other persons engaged in the sale of
intoxicating liquors, for the purpose of procuring or having
furnished to him, by sale, gift or otherwise, any
intoxicating liquors shall be deemed guilty of a
misdemeanor, and upon conviction thereof in any court of
competent jurisdiction shall be sentenced to pay a fine of
not more than twenty-five dollars ($25) or imprisoned in
jail for a period not exceeding thirty days.]

(A) IT IS UNLAWFUL FOR ANY PERSON UNDER THE AGE OF 18
YEARS TO KNOWINGLY AND FALSELY REPRESENT HIMSELF TO BE 18
YEARS OLD OR OLDER TO ANY LICENSED INNKEEPER OR OTHER PERSON
ENGAGED IN THE SALE OF INTOXICATING LIQUORS FOR THE PURPOSE
OF PROCURING OR HAVING FURNISHED TO HIM, BY SALE, GIFT, OR
OTHERWISE, ANY BEER OR LIGHT WINE OR ANY INTOXICATING
LIQUORS.

(A) IT IS UNLAWFUL FOR ANY PERSON UNDER THE AGE OF 21
YEARS, EXCEPT WHERE BEER AND LIGHT WINE IS INVOLVED, OR ANY
PERSON NOT DESIGNATED UNDER ARTICLE 2B, § 2(T)(2) OF THE
CODE, TO KNOWINGLY AND FALSELY REPRESENT HIMSELF TO BE 21
YEARS OLD, OR A PERSON DESIGNATED IN ARTICLE 2B, § 2(T)(2)
OF THE CODE IN THE CASE OF BEER AND LIGHT WINE, TO ANY
LICENSED INNKEEPER OR OTHER PERSON ENGAGED IN THE SALE OF
INTOXICATING LIQUORS FOR THE PURPOSE OF PROCURING OR HAVING
FURNISHED TO HIM, BY SALE, GIFT, OR OTHERWISE, ANY BEER OR
LIGHT WINE OR ANY INTOXICATING LIQUORS.

(B)  IT IS UNLAWFUL FOR ANY PERSON 18 YEARS OLD OR
OLDER BUT UNDER 21 YEARS OLD TO KNOWINGLY AND FALSELY
REPRESENT HIMSELF TO BE 21 YEARS OF AGE OR OLDER TO ANY
LICENSED INNKEEPER OR OTHER PERSON ENGAGED IN THE SALE OF
INTOXICATING LIQUORS FOR THE PURPOSE OF PROCURING OR HAVING
FURNISHED TO HIM BY SALE, GIFT, OR OTHERWISE, ANY
INTOXICATING LIQUOR EXCEPT BEER AND LIGHT WINE.

403A.

(A) ANY PERSON UNDER THE AGE OF 18 YEARS WHO VIOLATES
THE PROVISIONS OF THIS SUBHEADING SHALL BE ISSUED A CITATION
BY A POLICE OFFICER AUTHORIZED TO MAKE ARRESTS AND SHALL BE
SUBJECT TO THE PROCEDURES AND DISPOSITIONS PROVIDED IN
SUBTITLE 8 OF TITLE 3 OF THE COURTS AND JUDICIAL PROCEEDINGS
