Annotated Code of Maryland

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That section(s) of the Annotated Code of Maryland
read(s) as follows:
Article 2B - Alcoholic Beverages
[47.
In Baltimore County, the board of license commissioners
shall not approve any license to sell alcoholic beverages
within three hundred feet of any school, church or other
place of worship or within one and one-half miles from the
corner of 4th and D Streets in Sparrows Point. The said
three hundred feet are measured from the nearest point of
the building of the proposed establishment to the nearest
point of the building of the school, church or other places
of worship. Nothing in this section shall apply to or
affect or prohibit, in any manner, the renewal or transfer
of any license of any establishment where, subsequent to the
original granting of said license a school or church
building was erected within 300 feet. This provision shall
not apply to the issuance of special and temporary
licenses.]
47. 47A.
(A) IN BALTIMORE COUNTY, THE BOARD OF LICENSE
COMMISSIONERS MAY NOT ISSUE MORE THAN:
(1) 1 (ON-SALE) LICENSE, EXCLUDING CLUB
LICENSES, FOR EACH UNIT OF 2,500 PEOPLE IN ANY ONE ELECTION
DISTRICT, BASED UPON POPULATION FIGURES FURNISHED TO THE
BOARD BY THE BALTIMORE COUNTY OFFICE OF PLANNING AND ZONING.
A LICENSE ISSUED UNDER THIS PARAGRAPH MAY NOT BE TRANSFERRED
FROM ONE ELECTION DISTRICT TO ANOTHER.
(2) 1 (OFF-SALE) LICENSE, EXCLUDING CLUB
LICENSES, FOR EACH UNIT OF 4,000 PEOPLE IN ANY ONE ELECTION
DISTRICT, BASED UPON POPULATION FIGURES FURNISHED TO THE
BOARD BY THE BALTIMORE COUNTY OFFICE OF PLANNING AND ZONING.
A LICENSE ISSUED UNDER THIS PARAGRAPH MAY NOT BE TRANSFERRED
FROM ONE ELECTION DISTRICT TO ANOTHER.
(B) (3) 1 CLASS A (OFF-SALE) BEER, WINE AND LIQUOR
LICENSE TO A PLACE OF BUSINESS LOCATED IN A SHOPPING CENTER
WITH:
(I) AT LEAST 250,000 SQUARE FEET OF LEASED
STORE SPACE;
