(B)  APPLICATIONS FOR CERTIFICATION.

AN APPLICANT FOR CERTIFICATION SHALL SUBMIT AN
APPLICATION TO THE ADMINISTRATION ON THE FORM THAT THE
ADMINISTRATION REQUIRES.

(C)  ISSUANCE OF CERTIFICATE.

THE ADMINISTRATION SHALL ISSUE A CERTIFICATE TO ANY
APPLICANT WHO MEETS THE REQUIREMENTS OF THIS SUBTITLE.

(D)  DENIALS.

BEFORE THE ADMINISTRATION DISAPPROVES AN APPLICATION,
THE ADMINISTRATION SHALL GIVE THE APPLICANT AN OPPORTUNITY
FOR A PUBLIC HEARING.

REVISOR'S NOTE: Subsection (a) of this section is new
language derived without substantive change from
the second sentence of former Article 43B, §
19(a) and rephrased to state expressly that the
applicant must comply with the requirements of
the Administration.

Subsections (b) and (d) of this section are new
language derived without substantive change from
the first and second sentences of former Article
43B, § 19(b).

Subsection (c) of this section is standard
language added to express the formerly implied
duty of the Administration to issue a certificate
to a qualified applicant.

In subsection (b) of this section, the reference
to "the form that the Administration requires" is
new language added to express the formerly
implied provision that applications may be made
only on the form required by the Administration.

The third sentence of former' Article 43B, §
19(b), which required the Administration to hold
a requested hearing, is deleted as implicit in
the reference in subsection (d) of this section
to "an opportunity for a public hearing."

The Commission to Revise the Annotated Code
notes, for consideration by the General Assembly,
that there is no express provision for suspension
or revocation of this certification. While, the
rules and regulations of the Administration do
provide procedures, the General Assembly may wish
to provide express procedures in this section.
