(5) "HOUSEHOLD" MEANS ONLY THOSE PERSONS

DOMICILED IN THE UNIT AT THE TIME THE NOTICE REQUIRED BY §

11-102.1 IS GIVEN.

[(c)] (B) A developer may not [sell] GRANT a unit IN A
RENTAL FACILITY [leased] OCCUPIED by a designated [family]
HOUSEHOLD ENTITLED TO RECEIVE THE NOTICE REQUIRED BY §
11-102.1 without offering to [that family] THE TENANT OF THE
UNIT a lease extension for a period of at least 3 years from
the [date of the issuance of the notice of intention to
create a condominium] GIVING OF THE NOTICE REQUIRED BY §
11-102.1, if the [family] HOUSEHOLD meets the following
criteria:

[(1) Has an annual income which does not exceed
80 percent of the median income for the standard
metropolitan statistical area in which the rental facility
is located or for the county or municipal corporation in
which the rental facility is located, whichever is greater,
unless the local governing body elects to use the lesser
amount;]

(1)  HAD AN ANNUAL INCOME WHICH DID NOT EXCEED
THE INCOME ELIGIBILITY FIGURE APPLICABLE FOR THE COUNTY OR
INCORPORATED MUNICIPALITY IN WHICH THE RENTAL FACILITY IS
LOCATED, AS PROVIDED UNDER SUBSECTION (N);

(2)  [Has not failed to pay rent due in a timely
fashion or] IS CURRENT IN ITS RENT PAYMENT AND HAS NOT
violated any other material term of the [tenancy] LEASE;

(3)  [Has notified the developer in writing
within 60 days after receipt of notice of intention to
create a condominium:

(i) That the family is a designated
family; and

(ii) That the family will not purchase its
unit at that time; and

(4)] Has provided the developer WITHIN 60 DAYS
AFTER THE GIVING OF THE NOTICE REQUIRED BY § 11.102.1 with
AN AFFIDAVIT UNDER PENALTY OF PERJURY [notarized
documentation of the family's annual income within 180 days
after notice of intention to create a condominium.]:

(I)  STATING THAT THE HOUSEHOLD IS APPLYING
FOR AN EXTENDED LEASE UNDER THIS SECTION;

(II)  SETTING FORTH THE HOUSEHOLD'S ANNUAL
INCOME FOR THE CALENDAR YEAR PRECEDING THE GIVING OF THE
NOTICE REQUIRED BY § 11-102.1 TOGETHER WITH REASONABLE
SUPPORTING DOCUMENTATION DOCUMENTATION;
