PRIVATE AGENCIES, SHALL DIRECT AND CONDUCT BASIC RESEARCH IN
DRUG ABUSE, INCLUDING CLINICAL EPIDEMIOLOGICAL, SOCIAL
SCIENCE, AND STATISTICAL RESEARCH; AND
(II) SHALL DEVELOP PILOT PROGRAMS.
(2) FOR THESE PURPOSES AND NOTWITHSTANDING ANY
OTHER LAW, THE ADMINISTRATION MAY ESTABLISH, DIRECT, AND
CONDUCT ANY EXPERIMENTAL PILOT CLINICAL PROGRAM FOR THE
TREATMENT OF DRUG ABUSERS, INCLUDING ANY PROGRAM TO
ADMINISTER, UNDER MEDICAL SUPERVISION AND CONTROL,
MAINTENANCE DOSAGES OF ADDICTING DRUGS.
(C) PROGRAMS IN CORRECTIONAL INSTITUTIONS.
IN COOPERATION WITH THE DEPARTMENT OF PUBLIC SAFETY AND
CORRECTIONAL SERVICES OR ANY OTHER APPROPRIATE CORRECTIONAL
AGENCY, THE ADMINISTRATION MAY ESTABLISH AND MAINTAIN, IN
ANY CORRECTIONAL INSTITUTION IN THIS STATE, PROGRAMS FOR THE
PREVENTION AND TREATMENT OF DRUG ABUSE AND FOR THE
REHABILITATION OF DRUG ABUSERS.
REVISOR'S NOTE: This section is new language derived
without substantive change from former Article
43B, §§ 5(b) and (c) and 18.
In subsections (a) and (b)(1)(ii) of this
section, the former references to spending
"within the amount made available by
appropriation" are deleted as unnecessary in
light of Article 15A, § 14 of the Code, which
prohibits expenditures in excess of
appropriations.
In subsection (a) of this section, the reference
to "public or private agencies'" is substituted
for the reference to "other federal, State, local
and private agencies", for consistency with the
reference in subsection (b)(1)(i) of this
section.
In subsection (a) of this section, the former
reference "{w}ith the advice of the Council" is
deleted as unnecessary in light of § 9-305 of
this title and as incomplete in light of the
authority of the Secretary under § 9-203(a) of
this title and of the Director of Education and
Training under § 9-205 of this title.
Also in subsection (a) of this section, the
former reference to "implement and administer
such programs" is deleted as unnecessary in light
of the word "conduct".
