(2) Zoning officials may deliver a citation to
any person whom they believe to be committing a civil zoning
violation. A copy of the citation shall be retained by the
zoning official and shall bear his certification attesting
to the truth of the matter set forth. The citation shall
also contain:
(i) The name and address of the person
charged;
(ii) The nature of the violation;
(iii) The place where and time that the
violation occurred;
(iv) The amount of the fine assessed;
(v) The manner, location, and time in
which the fine may be paid to the County Commissioners; and
(vi) The person's right to elect to stand
trial for the violation.
(4) A preset fine not to exceed $100 may be
imposed for each violation, and the County Commissioners may
establish a schedule of preset fines for each violation. A
preset, fine is payable by the recipient of the citation to a
County Commissioners within 20 calendar days of the receipt
of the citation.
(5) A person receiving a citation may elect to
stand trial for the offense by notifying the Commission of
his intention of standing trial. The notice shall be given
at least 5 days prior to the date of payment as set forth in
the citation. Upon receipt of the notice of the intention
to stand trial, the Commission shall forward to the District
Court having venue a copy of the citation and the notice
from the person who received the citation indicating his
intention to stand trial. Upon receipt of the citation, the
District Court shall schedule the case for trial and notify
the defendant of the trial date. All fines, penalties, or
forfeitures collected by the District Court for zoning
violations shall be remitted to the County Commissioners.
(6) If a person receiving a citation for a
violation fails to pay the fine therefor by the date of
payment set forth on the citation and fails to file a notice
of his intention to stand trial for the offense, a formal
notice of the violation shall be sent to the owner's last
known address. If the citation has not been satisfied
within 15 days from the date of the notice, he shall be
liable for an additional fine not to exceed twice the
original fine. If after 35 days the citation has not been
satisfied, the Commission may request adjudication of the
