9-207. ACCEPTANCE AND USE OF SPECIAL FUNDS.

(A)  ACCEPTANCE OF GIFTS OR GRANTS.

WITH THE APPROVAL OF THE SECRETARY OF BUDGET AND FISCAL
PLANNING, THE ADMINISTRATION SHALL ACCEPT, ON BEHALF OF THIS
STATE, A CONDITIONAL OR UNCONDITIONAL GIFT OR GRANT.

(B)  DISPOSITION AND USE OF FUNDS.

THE ADMINISTRATION SHALL PAY ALL FUNDS COLLECTED UNDER
THIS SECTION INTO A SPECIAL FUND OF THE STATE TREASURY AND
USE THE SPECIAL FUND TO CARRY OUT THE PROVISIONS OF THIS
TITLE.

REVISOR'S NOTE: This section is new language derived
without substantive change from former Article
43B, § 5(m).

In subsection (a) of this section, the former
words "devise" and "bequest" are deleted as
unnecessary in light of the definition of "gift"
in Article 1, § 22 of the Code.

As to approval of the Governor before acceptance,
see Article 15A, § 5 of the Code.

The Commission to Revise the Annotated Code
notes, for consideration by the General Assembly,
that under former Article 43B, § 5(m) -- now
subsection (a) of this section — the
Administration is required to accept gifts or
grants. The General Assembly may wish to
consider whether this provision should be
discretionary.
