of Common Pleas of Baltimore City], the applicant for such
license shall first file with the clerk, in duplicate, a
written application therefor in such form, and verified in
such manner, and containing such information as may be
prescribed by regulations of the Comptroller. On or before
the 10th day of each month the said clerk shall forward to
the State Department of Assessments and Taxation a duplicate
copy of each of the above-named licenses issued by him
during the preceding month, together with a duplicate copy
of the application for each such license. Provided,
however, that this section, insofar as it relates to
licenses for restaurants, shall not apply in Montgomery
County, wherein such licenses shall be issued by the county,
subject to such regulations, fees and charges in connection
therewith and penalties for the violation thereof as may be
prescribed by the County Council. However, within the
confines of Baltimore County the clerk of the court may not
issue any new or transferred traders license without first
securing the approval of the zoning commissioner or his
designated agent. In Howard County (1) the clerk of the
court may not issue any new or transferred trader's license
without first securing the approval of the director of the
office of planning and zoning or his designated agent, and
(2) the director or his designated agent must notify the
clerk of the court of his approval or disapproval within 3
working days after the license application is submitted to
him for review.

11.

(d) For the purpose of enforcing the provisions of
this article the Comptroller or any duly authorized agent or
representative designated by him:

(1)  May conduct investigations and hold hearings
concerning any matter covered by this subtitle at any time
or place within the State of Maryland.

(2)  In the conduct of any investigation or
hearing, may require by subpoena or summons the attendance
and testimony of witnesses and the production of any books,
accounts, records, papers and correspondence relating to any
matter, which the Comptroller is authorized by this subtitle
to determine.

(3)  May sign subpoenas, administer oaths and
affirmations, examine witnesses and receive evidence.

(4)  In case of disobedience of any subpoena; or
the contumacy of any witness appearing before the
Comptroller or his duly authorized agent or representative,
the Comptroller may apply to the circuit court of any of the
counties [or to the Baltimore City Court] for an order.
Such court may thereupon issue an order requiring the person
subpoenaed to obey the subpoena or to give evidence or
