(b) The Director of the State Department of
Legislative Reference is the executive head of the
Department. THE DIRECTOR SHALL SERVE IN A NONPARTISAN
CAPACITY AND CONDUCT THE AFFAIRS OF THE DEPARTMENT IN SUCH A
MANNER. He shall be appointed jointly by the President of
the Senate and the Speaker of the House of Delegates and
shall have general administrative control over the
operations and functions of the Department, SUBJECT TO THE
POLICIES AND DIRECTIVES OF THE PRESIDENT AND SPEAKER. The
Director shall [hold office indefinitely and shall be
subject to removal by] SERVE AT THE PLEASURE WITHOUT A FIXED
TERM AND SHALL BE SUBJECT TO REMOVAL BY THE LEGISLATIVE
POLICY COMMITTEE UPON THE RECOMMENDATION OF the President
and the Speaker [upon proof of inefficiency, neglect of
duty, misconduct in office, or other cause; but before any
Director may be removed from office he shall be given a copy
of the charges made against him and an opportunity of being
publicly heard in person or by counsel in his own defense,
upon not less than ten days' notice].
52.
(A) The Director and employees of the Department of
Legislative Reference shall receive such compensation as
shall be provided in the State budget and the operating
expenses of the Department shall be as provided in [said]
THE budget.
(B) (1) EXCEPT FOR THOSE POSITIONS DESCRIBED IN
PARAGRAPH (2), ALL POSITIONS AUTHORIZED FOR THE DEPARTMENT
ARE UNCLASSIFIED POSITIONS.
(2) WITH THE JOINT APPROVAL OF THE PRESIDENT OF
THE SENATE AND THE SPEAKER OF THE HOUSE OF DELEGATES, THE
DIRECTOR MAY DETERMINE THAT SOME OF THESE POSITIONS ARE
CLASSIFIED POSITIONS.
(3) ALL UNCLASSIFIED POSITIONS IN THIS
SUBSECTION SHALL BE CONSIDERED TO BE LIKE PROFESSIONAL
POSITIONS.
(4) (3) IN THIS SUBTITLE "PROFESSIONAL
POSITIONS" MEANS THOSE POSITIONS IN THE DEPARTMENT KNOWN AS
LEGISLATIVE ANALYSTS (PERSONS WHO SHALL REVISE STATUTES,
SHALL STAFF THE NONFISCAL STANDING COMMITTEES ENUMERATED IN
THE RULES OF THE TWO CHAMBERS AND OTHER COMMITTEES, AND
SHALL DRAFT AND ANALYZE LEGISLATION, AMONG OTHER DUTIES) AND
LEGISLATIVE RESEARCH ANALYSTS (PERSONS WHO SHALL COLLECT AND
ANALYZE INFORMATION ON ISSUES BEFORE OR EXPECTED TO BE
BEFORE THE LEGISLATURE).
(C) THE PRESIDENT AND SPEAKER PROMULGATE
GUIDELINES, UPON THE REQUEST OF THE DIRECTOR, WHICH
