IN CARRYING OUT §§ 8-501 AND 8-502 OF THIS SUBTITLE,
THE POLICE SHALL MAKE EVERY REASONABLE EFFORT TO PROTECT THE
HEALTH AND SAFETY OF THE INTOXICATED INDIVIDUAL.

without substantive change from the first
sentence of former Article 2C, § 303(e).

8-504. VOLUNTARY ADMISSIONS.

AN INTOXICATED INDIVIDUAL MAY GO VOLUNTARILY TO A
DETOXIFICATION CENTER FOR MEDICAL OR PARAMEDICAL ATTENTION.
HOWEVER, THE CENTER SHALL GIVE PRIORITY TO INDIVIDUALS WHO
ARE UNABLE TO DECIDE RATIONALLY ABOUT HELP OR OTHERWISE ARE
IN IMMEDIATE MEDICAL DANGER.

8-505. DETOXIFICATION CENTERS -- IN GENERAL.

(A)  DETERMINATIONS.

THE ADMINISTRATIVE HEAD OF A DETOXIFICATION CENTER MAY
DETERMINE WHETHER AN INDIVIDUAL IS:

(1)  TO BE GIVEN MEDICAL OR PARAMEDICAL
ATTENTION, WITHOUT BEING ADMITTED TO THE CENTER;

(2)  TO BE ADMITTED TO THE CENTER;

(3)  TO BE REFERRED TO ANOTHER APPROPRIATE
FACILITY FOR CARE AND TREATMENT; OR

(4)  TO BE DENIED ATTENTION, ADMISSION, AND
REFERRAL.

(B)  REFERRALS.

IF THE ADMINISTRATIVE HEAD OF THE CENTER DETERMINES
THAT THE INDIVIDUAL SHOULD RECEIVE TREATMENT AT ANOTHER
FACILITY, THE ADMINISTRATIVE HEAD SHALL ARRANGE FOR THAT
TREATMENT AND FOR TRANSPORTATION TO THAT FACILITY.

(C)- DENIALS OF ADMISSION OR REFERRAL.

IF THE INDIVIDUAL IS DENIED ADMISSION AND REFERRAL AND
HAS NO MONEY, AUTHORIZED PERSONNEL SHALL OFFER:

(1)  TO TAKE THE INDIVIDUAL HOME; OR

(2)  IF THE INDIVIDUAL HAS NO HOME, TO FIND FOR
THE INDIVIDUAL ANOTHER FACILITY WHERE THE INDIVIDUAL MAY
OBTAIN SHELTER.
