Health Planning AND DEVELOPMENT Agency [or any successor
agency,] and being or to be, in fact, a health care facility
available to the general public maintained and operated as a
nonprofit institution by some person, association, municipal
or other corporation, or other agency, or a nonprofit
corporation organized for the purpose of constructing or
acquiring such a hospital, related institution or
combination of a hospital and a related institution.

(a) A certificate or policy of sickness and accident
insurance or of automobile insurance that provides or pays
for health care benefits may not contain any provision that
denies or reduces benefits because services are rendered to
a certificate or policy holder or a beneficiary who is
eligible for or receiving medical assistance under [Article
43, § 42 of the Code] § 15-103 OF THE HEALTH - GENERAL
ARTICLE.

(c) Home health care shall be provided:
(2) By a public or private health service or
agency which is licensed as a home health agency pursuant to
[Article 43] TITLE 19, SUBTITLE 4 OF THE HEALTH - GENERAL
ARTICLE to provide coordinated home care.
