[(b)] (A) [Upon] ON application of the [Washington
Suburban Sanitary Commission] WSSC, verified by oath [or
affirmation] of a member or employee [thereof] OF THE WSSC,
the circuit court of any county, sitting in equity, [may,]
by injunction[,] MAY:
(1) [enforce] ENFORCE the compliance with[,] or
restrain the violation off,] any order, [or] notice, or
rule, or regulation[,] of the [commission] WSSC [made
pursuant to] UNDER the provisions of this article[,]; [or]
(2) [restrain] RESTRAIN the violation or
attempted violation of any of the provisions of this
article[,]; [or]
(3) [require] REQUIRE the compliance with any of
the provisions of this article[,] by any person[, firm or
corporation]; or
(4) [require] REQUIRE the entry of any employee
or agent of the [commission] WSSC within a designated area
[upon] ON the private premises and into any building in the
sanitary district where the [commission] WSSC shows a
violation of this article.
(B) The court [shall] MAY not require the [commission]
WSSC to post a bond.
(C) [In the event] IF the respondent in a petition for
injunction [pursuant to] UNDER this subsection is a
nonresident of [the] THIS State [of Maryland], process by
publication shall be effected [pursuant to] UNDER Rule 105
of the Maryland Rules of Procedure.
(D) AS TO §§ 10-101 THROUGH 10-103, INCLUSIVE, OF THIS
ARTICLE:
(1) MONTGOMERY COUNTY MAY APPLY THE PROVISIONS
OF THIS SECTION IF AN APPLICATION IS VERIFIED BY OATH OF AN
EMPLOYEE OF MONTGOMERY COUNTY; AND
(2) THE COURT MAY NOT REQUIRE MONTGOMERY COUNTY
TO POST A BOND.
[18-8] 18-106. Payment of damages.
(a) (1) Except as provided in subsection (b) OF THIS
SECTION, the [commission is authorized] WSSC, [pursuant to]
UNDER RULES OR regulations [promulgated] ADOPTED by [it] THE
WSSC, [to] MAY pay for actual property damage caused by a
sanitary sewer backup occurring on or after July 1, 1979[,
or for damage caused by a sanitary sewer backup occurring
prior to July 1, 1979, if a claim for damage caused by the
backup is pending before the commission on July 1, 1979].
