COMMITTEE NOTE: Former Article 67, § 13-6.1(a) is
proposed for repeal as obsolete. All contractual
agreements have already been put into force, and
the marina has been transferred from the WSSC to
the M-NCPPC.
[(b) The provisions of subsection (a) may not be
construed to affect or impair the obligation of the
Washington Suburban Sanitary Commission or the Washington
Suburban Sanitary District, or of Prince George's County, or
the Maryland-National Capital Park and Planning Commission,
or the State Highway Administration (formerly State Roads
Commission), under any bonds now outstanding, or the
guarantee of any bonds now outstanding which may have been
issued under the provisions of the Anacostia River Flood
Control and Navigation Act (chapter 522 of the Acts of 1953,
as amended), or the Marina and Boat Basin Act (chapter 618
of the Acts of 1959). Except as expressly provided in
subsections (a) and (c), this act shall not be construed to
affect or impair the obligation of the Washington Suburban
Sanitary Commission under those certain assurances of local
cooperation executed 16 March and 15 June 1954 between the
Washington Suburban Sanitary Commission and the United
States of America.]
COMMITTEE NOTE: Former Article 67, § 13-6.1(b) is
proposed for repeal as obsolete. However,
uncodified Section 3 of this bill provides that
"this Act does not affect or impair any bonds
that are outstanding on July 1, 1982" (the
effective date of the bill).
[(c) Upon approval by the Secretary of the Army of the
new assurances executed pursuant to subsection (a) and upon
fulfillment of all other conditions set forth in subsection
(a), the Maryland-National Capital Park and Planning
Commission is designated as the organization responsible for
the administration, maintenance and operation of the marina
and boat basin operation established by chapter 618 of the
Acts of 1959, including the responsibility for dredging.
The Maryland-National Capital Park and Planning Commission
shall adopt and publish rules and regulations for the use
and enjoyment of the marina and boat basin which will assure
that the improvements and facilities shall be open to all on
equal terms. The Maryland-National Capital Park and
Planning Commission shall fix the charges for the use of the
public and commercial navigation facilities, the proceeds of
which shall be accounted for in the enterprise fund
established pursuant to subsection (e). The county
governing body of Prince George's County shall levy and
collect, annually, upon all property assessed for county tax
purposes within Prince George's County, an ad valorem tax at
a rate certified as necessary by the Maryland-National
Capital Park and Planning Commission to produce annually the
