road, or alley within the Washington Suburban Sanitary
District in which the commission has installed a water,
sewer, or storm drainage structure, prior to commencing the
road construction work, shall give notice to the commission
of the proposed road construction work, with the notice to
include the proposed construction schedule with specificity
as to contemplated construction dates and construction
location information as required to accomplish the purposes
of this section. Except in emergency road repair
situations, when notice shall be given as promptly as
feasible under the emergency situations, the notice shall be
given to the commission by the contractor not less than
seven days prior to the commencement of the road
construction work. No individual, firm, or corporation
shall disturb, remove, pave over or repave over any manhole,
valve, fitting, or other water, sanitary sewer, or storm
drainage structure of the commission. The provisions of
this section may be enforced, or a violation thereof
enjoined, upon application of the commission, verified by
oath or affirmation of a member, department head, and/or
division engineer thereof, by the circuit court, sitting in
equity, of the county in which the commission structure is
located.]

(A)  (1) IN THIS SECTION THE FOLLOWING WORDS HAVE THE
MEANINGS INDICATED.

(2)  "CONSTRUCTION CONTRACTOR" MEANS ANY PERSON
WHO PERFORMS OR WHO IS ENGAGED OR HIRED TO PERFORM ROAD
CONSTRUCTION WORK.

(3)  "ROAD CONSTRUCTION WORK" MEANS THE
CONSTRUCTION, REPAIR, PAVING, REPAVING, OR GRADING OF A
PUBLIC ROADWAY.

(B)  (1) BEFORE BEGINNING ROAD CONSTRUCTION WORK ON A
PUBLIC ROADWAY IN THE SANITARY DISTRICT IN WHICH THE WSSC
HAS INSTALLED A WATER, SEWER, OR STORM DRAINAGE STRUCTURE, A
CONSTRUCTION CONTRACTOR SHALL NOTIFY THE WSSC ABOUT THE
PROPOSED ROAD CONSTRUCTION WORK.

(2) THE NOTICE:

(I)  SHALL INCLUDE THE PROPOSED
CONSTRUCTION SCHEDULE AND INFORMATION ABOUT THE LOCATION OF
CONSTRUCTION TO ACCOMPLISH THE PURPOSES OF THIS SECTION;

(II)  EXCEPT IN EMERGENCY ROAD REPAIR
SITUATIONS, SHALL BE GIVEN TO THE WSSC AT LEAST 7 DAYS
BEFORE ROAD CONSTRUCTION WORK BEGINS; AND

(III)  IN EMERGENCY ROAD REPAIR SITUATIONS,
SHALL BE GIVEN TO THE WSSC AS PROMPTLY AS FEASIBLE UNDER THE
EMERGENCY SITUATION.
