(II) THE PHYSICAL LOCATION OF THE CONDUIT,
MAIN, OR PIPE IS CHANGED FROM THAT SHOWN ON THE PLANS
APPROVED BY THE WSSC.

(2)  THE PERSON OR SUCCESSOR OF THE PERSON WHO
CONSTRUCTED THE CONDUIT, MAIN, OR PIPE SHALL PAY THE
EXPENSES OF THE REMOVAL OR CHANGE IN LOCATION.

(3)  THE WSSC IS NOT LIABLE FOR DAMAGE DONE TO
THE CONDUIT, MAIN, OR PIPE BECAUSE OF THE CONSTRUCTION OR
MAINTENANCE OF THE WSSC WATER AND SEWER SYSTEMS.

[Any violation of the provisions of this section shall
be a misdemeanor punishable under section 18-7 of this
article.]

COMMITTEE NOTE: The last sentence of former Article 67,
§ 10-3 now appears in Title 18 of this article.

[10-4. Same — Charges for permits, etc.]

(D) The [Washington Suburban Sanitary Commission] WSSC
[is hereby given authority to] MAY [make a reasonable]
charge A REASONABLE FEE for a permit and for [such]
engineering services [as it] THAT THE WSSC is required to
perform under [the provision of] THIS section [10-3].

[10-5] 10-106. Reimbursement for relocation.

(A) [After June 1, 1957, the county council of]
Montgomery County or [the county commissioners of] Prince
George's County],] shall pay [1/2] ONE HALF of the actual
cost [within their] IN THE respective [counties] COUNTY that
the [Washington Suburban Sanitary Commission may] WSSC [be]
IS required to pay for the relocation or removal of any [of
its] WSSC [facilities] FACILITY [by reason] BECAUSE of any
road construction or improvement required by [any of the
agencies above set forth] EITHER COUNTY.

[If any of the above agencies require the relocation or
the removal of any of the facilities of the commission it
shall give notice to the commission within a reasonable time
of its requirements and upon receipt of which the commission
shall furnish to such agency an estimate of the cost of such
removal or relocation, and upon the completion of such
removal or relocation, shall furnish to such agency an
itemized statement of the actual cost of such removal or
relocation, and unless such agency disputes any one or more
of the charges in the bill rendered by the commission, it
shall pay the same within six months after its receipt.]

(B)(1) IF A COUNTY REQUIRES THE RELOCATION OR REMOVAL
OF ANY WSSC FACILITY, THE APPROPRIATE COUNTY SHALL NOTIFY
THE WSSC WITHIN A REASONABLE TIME OF ANY REQUIREMENT.
