with any of the provisions of this section by any person,
firm: or corporation. The court shall not require the
posting of a bond by Montgomery County or the Commission.]

[10-2] 10-104. Public utilities construction.

(A)  The [Washington Suburban Sanitary Commission]
WSSC, in addition to the authority over the construction and
location of underground construction [within] IN the
sanitary district, [shall have the authority to] MAY
regulate the construction of any overhead [lines] LINE,
[poles] POLE, or other public [utilities] UTILITY
[construction within the district,] along any [state or
county road, or street, or alley, within] PUBLIC ROADWAY IN
the SANITARY district[, and no].

(B)  A person[, corporation, or firm shall] MAY NOT
erect any pole or other structure for the purpose of
carrying wires overhead without first [having obtained]
OBTAINING a permit from the [commission] WSSC.

(C)  The [commission] WSSC may:

(1)  [require the filing of] REQUIRE THAT plans
[with it of such] FOR THE location or construction[,] OF THE
POLE OR STRUCTURE BE FILED WITH THE WSSC; and

(2)  [may charge] CHARGE a reasonable fee for
[such] THE permit.

[Any violation of the provisions of this section shall
be a misdemeanor, punishable under section 18-7.]

COMMITTEE NOTE: The last sentence of former Article 67,
§ 10-2 now appears in Title 18.

[10-3] 10-105. Removal of obstructions -- Generally.

[All individuals, firms and corporations having
buildings, conduits, pipes, tracks or other physical
obstructions in, over or under the public roads, streets or
alleys of the sanitary district, or of those portions of
Montgomery and Prince George's counties outside of the
district, which shall block or impede the progress of the
commission's water supply, sewerage or drainage system,
while in process of construction and establishment, shall,
upon reasonable notice from the commission promptly so
shift, adjust, accommodate or remove the same, at their own
cost and expense as to fully meet the exigencies occasioning
such notice;]
