(II) MAKES RECOMMENDATIONS TO THE
APPROPRIATE HEALTH OFFICIALS ON THESE POLICIES AND PROGRAMS.

REVISOR'S NOTE: This section is new language derived
without substantive change from the third
paragraph of former Article 2C, § 502(a).

In item (2) of this section, the word "statute"
is substituted for "law", to give effect to the
apparent intent of former Article 2C, § 502(a)
that these councils have a degree of permanence.
This substitution is based on the word
"ordinance", which otherwise would be
unnecessary.

In item (3) of this section, "only
responsibilities" is substituted for "sole
responsibility" to reflect that making
recommendations also is a responsibility.

8-312. COUNTY ADVISORY COUNCILS REQUIRED.

(A)   IN GENERAL.

EXCEPT AS OTHERWISE PROVIDED IN § 8-311 OF THIS
SUBTITLE AND SUBSECTION (B) OF THIS SECTION, THE GOVERNING
BODY OF EACH COUNTY SHALL ESTABLISH AN ALCOHOLISM ADVISORY
COUNCIL FOR THE COUNTY.

(B)   INTERCOUNTY ADVISORY COUNCIL.

THE GOVERNING BODIES OF TWO OR MORE COUNTIES MAY
ESTABLISH, BY AGREEMENT, AN INTERCOUNTY ALCOHOLISM ADVISORY
COUNCIL IF:

(1)  THE POPULATION OF ONE OF THE COUNTIES IS TOO
SMALL TO WARRANT THE ESTABLISHMENT OF AN ALCOHOLISM CONTROL
PROGRAM FOR THAT COUNTY; AND

(2)  THE DIRECTOR CONSENTS.

REVISOR'S NOTE: This section is new language derived
without substantive change from the first clause
of the first sentence of the first paragraph and
the entire second paragraph of former Article 2C,
§ 502(a).

In subsection (a) of this section, the former
reference to Baltimore City is deleted as
unnecessary in light of the use of the defined
term "county".
