for the protection of an individual's home, by any person,
firm, corporation, or municipality, unless the plan or
design is in accordance with the six-year capital
improvements program of the commission as described in
chapter 7 of this article and has been approved by the
Washington Suburban Sanitary Commission;]

(A) (1) THE WSSC AND ANY PERSON OR ANY MUNICIPALITY
MAY NOT ADOPT A DRAINAGE PLAN, SYSTEM, OR DESIGN, INCLUDING
A CAPITAL IMPROVEMENT PROGRAM FOR STORMWATER MANAGEMENT:

(I)  UNLESS THE DRAINAGE PLAN OR DESIGN IS
IN ACCORDANCE WITH THE 6-YEAR CAPITAL IMPROVEMENTS PROGRAM
OF THE WSSC UNDER TITLE 7 OF THIS ARTICLE AND IS APPROVED BY
THE WSSC;

(II)  EXCEPT AS PROVIDED IN PARAGRAPH (2)
OF THIS SUBSECTION; AND

(III)  EXCEPT FOR THE PROTECTION OF AN
INDIVIDUAL'S HOME.

(2) (I) [provided that in] IN the City of Bowie
or in Montgomery County, except for that portion of the City
of Takoma Park [now situated] LOCATED in Montgomery County,
the approval REQUIRED BY PARAGRAPH (1) OF THIS SUBSECTION
shall be GIVEN respectively by the City of Bowie or by
Montgomery County and not the [Washington Suburban Sanitary
Commission;] WSSC.

(II)  [provided, however, that whenever] IF
the City, of Bowie or Montgomery County[,] prepares a
DRAINAGE plan, system, or design, or [whenever] IF a
DRAINAGE plan, system, or design has been submitted to the
City of Bowie or Montgomery County, THE CITY OR MONTGOMERY
COUNTY SHALL SUBMIT a copy of the [same] PLAN, SYSTEM, OR
DESIGN [shall be submitted] to the [commission] WSSC, which
shall have a specified, reasonable time to review and
comment [thereon] ON THE PLAN, SYSTEM, OR DESIGN to the City
of Bowie or Montgomery County to indicate any [and all]
conflicts in the plan, system, or design with the
[commission's] existing or planned water supply or sanitary
sewer systems OF THE WSSC. [and the] THE approval by
Montgomery County or the City of Bowie shall avoid any of
the conflicts identified by the [commission] WSSC.

(III)  When the [commission] WSSC receives
a copy of a plan [submitted to or by] FROM the City of
Bowie, [it] THE WSSC shall promptly provide a copy to the
[governing body] COUNTY COUNCIL AND COUNTY EXECUTIVE of
Prince George's County for review and comment.

[(c)] (B) If the [commission] WSSC, after [review of]
REVIEWING a plan submitted by the City of Bowie, advises the
[city] CITY that [it] THE WSSC finds that construction in
