LAWS OF MARYLAND

Ch. 21

In subsections (a) and (b) of this section, the
defined term "State" facility" is substituted for
the references to a "public facility within the
jurisdiction of the Administration", for brevity.

Subsection (b) of this section is revised to
incorporate the substance of former Article 59A,
§ 3(n), which defined "nonbudgeted funds" for
purposes of former Article 59A, since the term
appears only in this section.

Defined terms:

"Mentally retarded individual" § 7-101
"Person" § 1-101 "State facility" § 7-101
"Secretary" § 1-101

SUBTITLE 10. SHORT TITLE.

7-1001. SHORT TITLE.

THIS TITLE MAY BE CITED AS THE "MARYLAND MENTAL
RETARDATION LAW".

REVISOR'S NOTE: This section formerly appeared as
Article 59A, § 1.

The word "Maryland" is added for clarity.

Former Article 43, § 44A is revised as § 7-205 of
this title and is covered by the short title,
which formerly applied only to Article 59A.

Former Article 59A, §§ 3(f), (t), and the second
sentence of (b), 24, 25, 25A, 30, 31, 32, and 33,

which related to financing of services for
mentally retarded individuals, now appear in
Title 16 of this article and, thus, no longer are
covered by this short title.

Similarly, former Article 59A, § 37, as that
section related to nonretarded developmentally
disabled individuals, now appears in § 19-601 of
this article.

The only other changes are in style.

Defined term: "Mental retardation" § 7-101

GENERAL REVISOR'S NOTE:

Former Article 59A, § 6, which required the Secretary
to adopt rules and regulations for purposes of this title,
is deleted as inconsistent with other provisions of this
title that impose the duty to adopt rules and regulations on
